Copyright claim with UMG & YouTube

A couple of weeks ago YouTube sent me a copyright claim. Content owner, UMG (Universal Music Group) claimed I was infringing their copyright and having illegal content (= music) on my video, called “Flair”.

In this video, filmed back in the day in Kalajoki, after a gig in Dyyni, shows the bartender flairing. It’s 37 seconds long and – indeed – if you listen carefully, there is some music playing in the background. Turn up the volume and you might even recognize the track being performed by Black Eyed Peas.

Now, judge it yourself – do you think that this amazing piece of video art is fair use of content or copyright infringing?

After my complaint I got a response today from YouTube which can be seen above.
According to the message this video is now blocked everywhere except Australia, Brazil, Canada, France, Guam, India, Ireland, Israel, Italy, Japan, Mexico, Netherlands, New Zealand, Northern Mariana Islands, Puerto Rico, South Korea, Spain, United States, United States Virgin Islands.
And where it’s allowed to be watched, the users will see ads when watching the video.

Just a short final thought – copyright in the form we know it now is dying. Companies trying to “protect” their content is ways like this are not winning the customers to their side but losing them, one by one.

Even though this wasn’t an important video for me at all, this incident pisses me off – a lot.

DJs should be respected and treated as music supporters and promoters by the corporations.

Not as stealers and infringers.

Rather than us paying to the corporations, artist and copyright representatives should rather pay us for promoting their music. As this won’t ever happen, I would refer to my previous note: Music marketing is becoming equal to distribution.

DJs should have a right to promote music in all the possible ways (mp3 blogs, podcasts, radio shows).

We should not pay any additional fees (such as Teosto’s digital djing or any file conversion fees).

We buy our music. We pay to the artists. We should not pay to the corporations, who can’t meet the expectations of today’s music business.

We should not fear for additional fees or lawsuit when playing artist promos. (At the moment playing promos gotten directly from any Teosto member is a similar to playing illegally downloaded tracks)

DJs should not be seen as a bunch of criminals disrespecting copyright, but as an enormous and potential (but neglected) force of marketing.

Starting in the early nineties from the warehouse raves of the industrial city of Tampere, stirring the Northern Finland electronic music scene for over five years, settling down in Helsinki in 2006 and moving to Berlin in 2011, Orion is one of the busiest DJs in Finland.

Probably the most well known of his work on Finnish National Radio YleX, Orion hosts his own 2 hour show every Friday night. He is also one of the former hosts of Tiistain Tanssi-ilta, the oldest EDM radio show in Finland. Next to his work at Misc. Management, the first Finnish dance music oriented DJ booking agency, he also produces orchestral chill-out music as half of Orion & J.Shore duo.

No matter if it’s about opening a sold-out event at Cable Factory with a chill-out live performance or a sweaty, hedonistic moment at after-hours, 30C pool party or -15C outdoor event, corporate music happening for Mini Cooper or Philip Morris or a small scale private party, full-on trance mayhem or groovey tech-house vibe, after nearly 20 years in the business it’s all still happening and it’s all labour of love.

“I’ve been lucky enough to have people around me who haven’t been there for money and fame but for the love to music. I guess none of us ever believed how big things could get far in the Finnish outback and I can’t give enough credit to all those who have been co-producing, supporting and helping with all the countless productions.”
